The Affiliate Agreement
Following are the terms and conditions for participating in the Custom-Choppers-Guide.com (Avalanche, LLC) Affiliate Program.
Please note that the terms "Affiliate", "you", and "your" shall refer to you the applicant and the terms "we", "our", and "us" shall apply to Custom-Choppers-Guide.com.
Requirements to Enroll
Joining our Program is free.
Affiliate attests to have read and agreed with the terms of this agreement prior to completing the ClickBank enrollment form and joining our program.
Our Responsibilities
Custom-Choppers-Guide.com (ARMS) will be responsible for processing all orders originating through Affiliate links.
Independent Affiliate Program Administrator
Our Affiliate Program is administered by ClickBank, an independent third party. You will receive a 40% commission for each sale that originated from a qualified Affiliate link on your web site, less the fees outlined in ClickBank's agreement http://www.clickbank.com/paychecks.html
Once you complete the ClickBank enrollment form to get your ClickBank Nickname, you need to sign up for our affiliate program. You can view your affiliate stats from the Affiliate Center which will provide you with your own account for tracking of sales originating from your web site, marketing tools, and more.
ClickBank will mail commission checks twice per month in accordance with their policies http://www.clickbank.com/paychecks.html. Conversely if a customer requests a refund for an order, ClickBank will deduct the amount from your next check.
Affiliate Responsibilities
Custom-Choppers-Guide.com (Avalanche, LLC) reserves the right to deny any site's participation in our Affiliate Program. However, sites that do not qualify for our Program include those which:
- promote pornography
- promote violence or hate
- promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
- promote illegal activities
- violate intellectual property rights
Affiliate also agrees not to participate in spamming…period. This practice is deemed inappropriate with Custom-Choppers-Guide.com policies. If violated, the Affiliate will be immediately removed from our program.
Legal Disclaimers
You agree that you are an independent contractor, and nothing in this Agreement shall create any form of partnership, joint venture, franchise, agency, or employment relationship between the parties.
You will not be treated as an employee with respect to the Internal Revenue Code, Social Security Act, Federal Unemployment Acts, or any other federal, state, or local statute, ordinance, rule, or regulation.
In addition, Custom-Choppers-Guide.com (Avalanche, LLC) makes no warranties, expressed or implied, as to the amount of income that you can earn by joining our Affiliate Program.
Custom-Choppers-Guide.com (ARMS) and its owners, principals, and assigns shall not be liable for any indirect, special, incidental or consequential damages arising out of the use or inability to use the ClickBank web site, service or information provided by ClickBank.
This includes, but is not limited to, lost profits, business interruption, and loss of information or programs. Similarly, we make no warranties that the operation of our site will operate error-free, and shall not be held liable for the consequences of any disruptions. In any event, our aggregate liability shall not exceed the total commissions paid or payable to you under this Agreement.
The terms and conditions of this agreement are subject to change according to business conditions or the policies of Custom-Choppers-Guide.com (ARMS). This shall also apply to future prices that may be extended to our customers for any of our products.
